Protective Injunctions

If you or your children are at risk of harm from a partner or family member, we can help to obtain protective orders from the court.

There are several orders the family court can make to help protect you or your children from harm, including:

  • Non-molestation Orders. These orders prohibit one party from contacting the other, or from acting in a certain way, or from attending a certain location.
  • Occupation Orders. These orders exclude one party from, part or all of, a property they would otherwise have a right to occupy (for example, the family home).

These applications can be made urgently, without informing the other person in advance, where this is necessary.

The threshold for making these orders, particularly without notice to the other person, is high and we can guide you through the process to ensure you have the best chance of success. We also appreciate that these applications will rarely happen in isolation, and we can support you with related family matters (such as disputes around child arrangements and finances).

As well as making these protective applications we are also experienced in responding to them and we can advise and assist you if you have been served with such an application or an order has already been made without notice to you.
